SECTION 391.309. Contract Awards During Protest

A contract will not be awarded that is subject to a properly filed protest until HHSC provides a final written disposition of the protest in accordance with §391.307 of this subchapter (relating to Review and Disposition of Protests). The HHSC Executive Commissioner may waive this requirement if the HHSC Executive Commissioner determines that HHSC must award a contract, without delay, to protect the best interests of the state.
