SECTION 375.349. What must a contractor do when reducing, suspending, or terminating benefits?

Contractors must follow procedures established by federal regulations in 45 CFR §400.54 as described in the Texas Refugee Cash Assistance Provider Manual when denying, reducing, suspending, or terminating benefits.
(1) If the action is taken because of a change in the size of the family unit, the contractor must give the participant written notice that: (A) clearly states the action, the reasons for the action, and the right to a hearing; (B) clearly states that the notice is for the Refugee Cash Assistance Program (RCA) and not any other program; and (C) is postmarked or provided in person to the participant at least 10 days before the effective date of the change. (2) If the action is taken because the participant has not fulfilled employment requirements, the contractor must give the participant written notice that: (A) clearly states the action, the reasons for the action, and the right to a fair hearing preceded by a review period; (B) clearly states that the notice is for RCA and not any other program; and (C) is postmarked or provided in person to the participant at least 10 days before the date of the change.
