(a) For the TANF Program, the federal law basis is: (1) Title IV of the Social Security Act (42 U.S.C. §601 et seq.); and (2) the federal regulations in 45 CFR, Parts 260 through 265. (b) To the extent the regulations described in subsection (a) of this section impose federal mandates that apply to Texas, HHSC incorporates the regulations by reference for administration of TANF in Texas. If the regulations provide options from which Texas may choose, or if Texas is granted a waiver from a federal mandate, the rules of this chapter and other applicable state administrative rules and policy describe the options Texas has chosen and the waivers Texas has been granted. (c) For the TANF Program, the state law basis is: (1) the Texas Human Resources Code, Chapter 31, which authorizes the Texas Health and Human Services Commission (HHSC) to administer the TANF Program in Texas; (2) the Texas Human Resources Code, Chapter 34, which authorizes HHSC to administer the TANF State Program; and (3) the rules of this chapter, as well as other applicable HHSC rules. (d) For SNAP, the federal law basis is: (1) 7 U.S.C. §2011 et seq.; and (2) the federal regulations in 7 CFR, Parts 271 through 283. (e) To the extent the regulations described in subsection (d) of this section impose federal mandates that apply to Texas, HHSC incorporates the regulations by reference for administration of SNAP in Texas. If the regulations provide options from which Texas may choose, or if Texas is granted a waiver from a federal mandate, the rules of this chapter and other applicable state administrative rules and policy describe the options Texas has chosen and the waivers Texas has been granted. (f) For SNAP, the state law basis is: (1) the Texas Human Resources Code, Chapter 33, which authorizes HHSC to administer SNAP in Texas; and (2) the rules of this chapter, as well as other applicable HHSC rules. (g) The Texas Workforce Commission provides TANF and SNAP employment and hiring activities and support services as described in Title 40 of the Texas Administrative Code, Chapter 811 (relating to Choices) and Chapter 813 (relating to Supplemental Nutrition Assistance Program Employment and Training).
