The following words and terms, when used in this subchapter, have the following meanings, unless the context clearly indicates otherwise:
(1) APA--the Administrative Procedure Act, Chapter 2001 of the Texas Government Code. (2) Adverse action--an action for which the right to a hearing under the Administrative Procedure Act is granted by the statute, rules or policy of a referring agency. (3) HHSC--the Texas Health and Human Services Commission. (4) Judge--a licensed attorney appointed by the director of the HHSC Appeals Division to preside over the case. (5) Referring agency--the HHSC agency taking the action and that issues the notice of adverse action, or the state agency that otherwise refers the matter to the HHSC Appeals Division for a hearing under this subchapter. HHSC agency includes the Texas Health and Human Services Commission, the Texas Department of Aging and Disability Services, the Texas Department of Assistive and Rehabilitative Services, the Texas Department of Family and Protective Services, and the Texas Department of State Health Services.
