SECTION 354.1809. Denial or Termination of Participation

(a) The Health and Human Services Commission (HHSC) reserves the right to deny an application for participation in the Medicaid program or to immediately suspend or terminate participation in the program should the pharmacy provider conduct pharmaceutical practices in violation of HHSC's Vendor Drug Program rules, state or federal laws, or the ethics adopted by the profession. (b) HHSC or its designee, on receipt of written request, provides an appeal to the provider if HHSC or its designee suspends or terminates the pharmacy provider's participation in the program for a violation described in subsection (a) of this section.
