SECTION 167.107. Appointment of a Mediator

(a) Unless the parties have provided notice to the Chief Judge or her designee that they have agreed to retain a mediator who meets the qualifications set forth in Insurance Code, §1467.054, the Chief Judge or her designee shall appoint a mediator from the roster of qualified mediators maintained by SOAH. Whenever practicable, the mediator shall be chosen randomly from the group of mediators located within the geographic region in which the mediation will be held. (b) If no mediator is on the roster or available from the geographic region that includes the county in which the mediation must be held pursuant to Insurance Code, §1467.052, SOAH shall appoint a mediator who is willing to travel from another geographic region to the county in which the mediation must be held.
