SECTION 12.125. Filing of Documents

(a) Motions, responses, and other documents in a formal hearing must be filed with the Commission: (1) by mail addressed to the commission at P.O. Box 12070, Austin, Texas 78711- 2070; (2) by hand-delivery to the commission at 201 East 14th Street, 10th Floor, Austin, Texas 78701; (3) by fax to the commission at (512) 463-5777; or (4) by email to a dedicated filing address. (b) All documents must clearly indicate the sworn complaint number and the name of the respondent for which it is filed. (c) Time of filing. With respect to documents filed by mail, fax, or hand-delivery, the time and date of filing shall be determined by the file stamp affixed by the commission. With respect to documents filed by email, the time and date of filing is the electronic time stamp affixed by the commission's email system. Documents received when the commission is closed shall be deemed filed the next business day. (d) Non-conforming documents. The commission may not refuse to file a document that fails to conform with this chapter. When a filed document fails to conform to this rule, the executive director or presiding officer may identify the errors to be corrected and state a deadline.
