SECTION 102.15. Excluded Activities

The following facilities or activities are not included within the definition of "health spa" in §702.003 of the Health Spa Act and are not required to register with the secretary under Chapter 702:
(1) facilities owned by organizations that are tax exempt under 26 United States Code 501 et seq.; (2) private clubs owned and operated by its members; (3) entities exclusively operated for teaching dance or aerobic exercise; (4) entities exclusively engaged in physical rehabilitation activity related to an individual's injury or disease; (5) an individual or entity engaged in an activity authorized under a valid license issued by this state; or (6) activities conducted or sanctioned by a school operating under the Education Code.
