SECTION 61.1041. Missing Child Prevention and Identification Program: Fingerprints and Photographs

(a) In accordance with the Texas Education Code, §33.054, a photograph of a student shall be retained by the participating school until the photograph is replaced by a photograph taken after the date of the original photograph or until the expiration of three years, whichever is earlier. (b) When a student withdraws from a school district, all photographs and fingerprints of the student taken as part of the Missing Child Prevention and Identification Program shall be returned to the parent or guardian of the student. If the district is unable to return the photograph and fingerprints to the parent or guardian, the photograph and fingerprints shall be destroyed by the school district.
