SECTION 7.210. Increasing Residential and Commercial Rates--Statement of Intent

(a) Contents. In addition to the information required in §7.205 of this title (relating to Contents of Statements of Intent and Petitions for Review of Municipal Action), the following information shall be included in each statement of intent to increase residential and commercial rates within the original jurisdiction of the Commission: (1) a statement as to whether the proposed rates will or will not exceed 115% of the average of all rates for similar services of all municipalities served by the same utility within the same county; (2) a statement as to whether the proposed change will or will not result in a "major change," as that term is defined in Texas Utilities Code, §104.101. (b) Requirement of additional information for cost of service increases in adjacent municipalities. If the utility proposes a rate for residential and commercial rates within the original jurisdiction of the Commission that is the same rate as the rate in effect in the nearest incorporated area in Texas served by the same utility, and the rate change in the municipality is the result of a cost of service adjustment clause as defined in §7.115 of this title (relating to Definitions), the gas utility shall file with the Director, in addition to the information listed in subsection (a) of this section, the following information: (1) all calculations used to derive the cost of service adjustment; (2) the effect of the proposed rates on each affected customer class; and (3) a copy of the cost of service adjustment clause in effect in the adjacent municipality.
