The following words and terms, when used in this division, shall have the following meanings, unless the context clearly indicates otherwise:
(1) Commission--The Railroad Commission of Texas. (2) Contractor--An independent contractor who has entered into a contract directly with the Commission. The term does not include: (A) a contractor's subcontractor, officer, employee, agent or other person furnishing goods or services to the contractor; (B) an employee of a unit of state government; or (C) a student at an institution of higher education. (3) Day--A calendar day. If an act is required to occur on a day falling on a Saturday, Sunday, or holiday, the first working day which is not one of these days shall be counted as the required day for the purpose of this division. (4) Director--The Executive Director of the Commission. (5) Division--Division 2 of Title 16, Part 1, Chapter 20, Subchapter A, of the Texas Administrative Code. (6) Mediation--Mediation is assigned the meaning set forth in Texas Civil Practice and Remedies Code, §154.023(a), or any successor statute. (7) Parties--A contractor and the Commission after entering into a contract in connection with which a claim of breach of contract has been filed under this division.
