(a) No person shall conduct any uranium exploration activity or surface mining operation without having first obtained a uranium exploration permit or surface mining permit issued by the commission pursuant to this subchapter and the Act. (b) The provisions of this chapter shall not apply to: (1) surface mining operations conducted on public lands regulated by the General Land Office of Texas; provided that such affected lands are reclaimed in a manner consistent with the provisions of this chapter; and (2) any land where the overburden has been removed and a mineral has been produced prior to June 21, 1975.
