SECTION 707.849. How is a due process hearing conducted?

A due process hearing is conducted according to the following procedural rules which are incorporated into this rule by reference:
(1) rules of the State Office Administrative Hearings (SOAH) found at 1 Texas Administrative Code Chapter 155 (relating to Rules of Procedure); (2) Texas Government Code, Chapter 2001, Administrative Procedures Act (APA) rules, to the extent that they do not conflict with the SOAH rules; and (3) the Texas Rules of Civil Procedure, to the extent that they do not conflict with the SOAH or APA rules.
